Fysique Apparel provides fitness clothing. We are not responsible for any injuries, health problems, or mishaps that occur while wearing our products. Always consult a professional before beginning a new fitness regimen. You use our gear at your own risk.

Assumption of Risk: By participating in any exercise program, workout, or physical activity offered, you acknowledge that you are aware that such activities involve inherent risks, including but not limited to, muscle strains, sprains, falls, broken bones, cardiovascular distress (including heart attack or stroke), or even death. You understand that these risks cannot be completely eliminated, regardless of the care taken by instructors or participants.

Medical Fitness and Consultation: You represent that you are in good physical condition and have no medical, health, or physical condition that would prevent or restrict your participation in activities with us. We strongly recommend that you consult a licensed physician or healthcare professional before beginning any new exercise routine, particularly if you have pre-existing injuries, cardiac conditions, diabetes, or respiratory problems.

Voluntary Participation and Self-Regulation: Participation is entirely voluntary. You agree to take full responsibility for your own safety and to monitor your own physical condition at all times. You agree to stop exercising immediately and seek medical attention if you experience pain, dizziness, light-headedness, faintness, or shortness of breath.

Release of Liability: To the maximum extent permitted by law, you agree to release, waive, discharge, and hold harmless Fysique Apparel, its employees, and agents from any and all claims, demands, damages, or causes of action arising from your participation, including those arising from negligence.

Equipment and Environment Safety: If participating remotely, you are responsible for ensuring your workout area is clear of hazards, obstacles, and has sufficient space. You are responsible for using any equipment properly and ensuring it is in good working order.

The following also applies to marketing campaigns and photoshoots. By engaging in activities, you acknowledge that you have read, understood, and agreed to the terms above.

License to Use Content: By tagging @fysique.apparel, using our branded hashtags, or submitting photos/videos via our website, you grant Fysique Apparel a perpetual, irrevocable, royalty-free, worldwide, and sub-licensable license to use, reproduce, modify, adapt, publish, and display your content. This includes, but is not limited to, our social media feeds, email marketing, and paid advertising (Facebook, Instagram, TikTok ads).

Influencer Relationship Disclosure: If you are an influencer, brand ambassador, or affiliate receiving free products or commissions from Fysique Apparel, you are legally required to comply with FTC Guidelines. This includes:

To the maximum extent permitted by law, Fysique Apparel disclaims any liability for direct, indirect, incidental, or consequential damages resulting from the use or misuse of our apparel. This includes any property damage or loss of time resulting from injuries sustained during, or as a result of, your fitness activities.
